Two commissions under U.S. regulation are losing members.

Only two commissioners remain.
Chairman Atkins and Commissioner Uyeda.
Both are Republicans.

Over at the CFTC, it’s even emptier.
Only one person is still in office.
With fewer people, votes are also easier to stall.
The CLARITY Act failed to pass in the Senate.
49 votes in favor, 50 against.

The SEC has been covering the gap itself during this period.
Last week, it updated a Q&A document.
The document says that when a crypto system can run properly
and there is no centralized controlling party,
the issuer can initiate buybacks for clients.
The document notes that it is non-binding.
The guidance is issued by staff and has no legal force.
The market can only price things based on this document for now.
The commission seats will be filled, but no timeline has been set.

For crypto, during the rule vacuum, the weight of administrative guidance increases.
With fewer people, the messaging is easier to shift.
