Crypto Regulation Is Moving — Even Without the CLARITY Act.
After the CLARITY Act failed to advance, the SEC and CFTC kept moving under existing authority. Recent actions include crypto classification guidance, Project Crypto, updated CFTC blockchain guidance and the SEC’s new exemption for certain tokenized U.S. stocks.
But these measures do not fully replace the CLARITY Act — major questions around jurisdiction and a durable market structure still require legislation or further rulemaking.
Congress stalled. The regulators didn’t.
