Senator Cynthia Lummis said that the CLARITY Act has applied anti-fraud liability under Section 17(a) of the Securities Act to disclosures concerning digital assets.

Bà Lummis said that Democratic senators previously requested that the issuance of cryptocurrency asset offerings be subject to anti-fraud responsibility standards similar to those of other entities filing securities offerings.

However, a procedural vote in the U.S. Senate on September 15 to advance the bill still was not passed.

The Senate file shows that the proposal did not reach the necessary threshold of 60 votes.
