The Clarity Act has just gone down in the Senate, and the crypto market is left without the regulatory framework that many expected. The procedural vote on September 15 did not pass, which means that the SEC and the CFTC retain full control over how to classify and regulate digital assets.

Why does it matter? Because without clear law, we’re stuck in limbo: each token can be a security or a commodity depending on the regulator’s mood. This discourages the entry of large institutional capital, which needs legal certainty before moving billions.

Key detail: this defeat gives the SEC more power to keep operating through enforcement (fines and lawsuits) rather than written rules. Coinbase, Kraken, and other exchanges are left exposed to shifts in criteria without warning.

But there’s another side: some believe that the lack of federal law leaves room for states to move forward with their own frameworks (such as Wyoming or Texas), creating fragmented regulation that can be more flexible.

What doesn’t change: regulatory ambiguity remains the main obstacle to the next wave of institutional bull growth. Without the Clarity Act, the path is longer.
