The “zero-fee” goal for switching scenarios under the Data Act has been implemented in advance and also covers non-switching scenarios.

Filecoin’s zero-export model has a first-mover advantage
On January 12, 2027, the EU Data Act will prohibit all cloud switching fees. Although, under Article 34, ongoing multi-cloud exits are still allowed to be charged at cost, with no room for profit. By 2031, the cloud storage market will reach $38 billion.
Filecoin has already set export fees to zero, regardless of whether a switch occurs.
The EU (Data Act) provisions on cloud switching fees
Chapter VI of the EU (Data Act) (Regulation (EU) 2023/2854) specifically governs the switching of providers of data processing services (mainly cloud services):
Starting January 12, 2027, providers may no longer charge any switching charges to customers, including data export fees related to switching. During the previous transition period (from January 11, 2024 to January 11, 2027), only the actual costs directly related to the switching process may be charged, with no markups or inclusion of indirect expenses.
