This arrangement is called a temporary innovation exemption—with conditions.
On the same day, the CFTC also expanded the scope of its software exemptions.
On the Senate side, the CLARITY Act failed 49 to 50.
With legislation stalled, regulators took a step first.
A licensing-based pool needs a whitelist, and retail investors may not be able to get in.
After stocks are put on-chain, the processes for settlement and transfer will be rewritten.
Market makers must obtain licenses, and the anti–money laundering requirements won’t be able to be avoided.
Both brokers and market makers are waiting to see the implementation details.
On-chain transactions happen in real time, and the idea of something like T+0 is no longer unusual.
If retail investors want to get in, they’ll have to take a detour through a compliant channel.
As compliant pools are built, the costs will be passed on through trading fees.
