Following the Senate's September 15 vote on H.R. 3633, CFTC Chairman Michael S. Selig said Americans need regulatory clarity, legal certainty, and consumer protection, while signaling that the agency is prepared to use its existing authority.

That distinction matters.

The CLARITY Act's procedural motion failed to advance, but regulatory work does not necessarily stop when legislation stalls. The SEC and CFTC have already taken steps in 2026 toward clearer treatment of crypto assets and closer coordination between the agencies.

For the market, the bigger story may be the direction of regulation rather than one individual vote.
