🧠 My take: CLARITY was written to limit agency arbitrariness—yet its failure made agencies the only source of clarity. What Congress didn’t provide, the SEC will: rules without a law — faster, but reversible. NEAR attorney is right: companies are again planning budgets around decisions in individual cases. Tillis’s proposal is a paper hope; the 5% on Polymarket is a market verdict.
