The U.S. Commodity Futures Trading Commission (CFTC) has formally filed a legal motion with the court, seeking the complete dismissal of the lawsuit previously brought by the Chicago Mercantile Exchange (CME) over cryptocurrency perpetual contracts—setting off a new wave in the months-long regulatory showdown over U.S. derivatives products.

The case stems from CME’s dissatisfaction with the CFTC’s decision to clear for trading the listing of Kalshi’s bitcoin perpetual contract on a prediction market platform via a fast-track process and a self-certification mechanism. CME argued that this went beyond congressional authorization and bypassed statutory procedures, and therefore filed suit in court. In its latest legal filing, the CFTC strongly rebutted CME’s claims, arguing that CME lacks legal standing and emphasizing that the regulator’s policy discretion over new crypto derivatives fully complies with the Commodity Exchange Act.

Industry analysis notes that cryptocurrency perpetual contracts have long been at the heart of the global derivatives market and a prime battleground. This latest move by the CFTC demonstrates its hardline stance in defending its regulatory decisions. If the court ultimately sides with the regulator’s position, it will not only help ensure the rollout of crypto perpetual contracts in the U.S. compliant market, but also establish an important precedent for future regulatory clashes between traditional exchanges and emerging crypto platforms.
