On August 25, the SEC submitted the updated “Custody Rules Amendments” to the White House Office of Management and Budget (OMB) for review. The core of the update is to restate how investment advisers and investment companies can comply when they custody clients’ crypto assets. The SEC regulatory agenda shows that the rule is expected to enter the formal proposal stage in October 2026, and it is not a final rule yet.
Key highlights
1. The biggest upside: barriers for institutional funds entering the crypto market may be lowered
Current custody rules create substantial compliance uncertainty for institutions holding clients’ crypto assets. The new rules explicitly aim to “modernize” the custody framework, while removing certain outdated requirements that increase burden but may not necessarily improve investor protection.
If the final rules allow more types of compliant institutions to participate in crypto custody, it could benefit:
BTC, ETH and other major assets Crypto ETFs and funds Banks, brokerages, and asset management institutions Custody/trading infrastructure companies such as Coinbase RWA and tokenized assets
2. Clear direction: more friendly than the 2023 proposal
In 2023, the SEC attempted to tighten the custody rules. At the time, it leaned toward requiring investment advisers to place clients’ crypto assets within a stricter “qualified custodian” framework, which was strongly opposed by the crypto industry. The old proposal ultimately did not take effect.
Now, under the leadership of SEC Chair Paul Atkins, the custody rules are being pushed again, with the regulatory tone clearly shifting to **“reduce compliance barriers + clarify the rules.”**
