Illinois is gearing up to implement a crypto trading tax, a 0.2% “privilege tax” is entering the actionable stage.

The Illinois legislature has passed the FY 2027 budget, which includes a provision to impose a 0.2% tax on cryptocurrency trades, to be collected by digital asset brokers. This tax measure is dubbed the “privilege tax” and is part of the amendment to the Digital Asset Privilege Tax Act. Furthermore, the legislation mandates that all digital asset brokers operating in Illinois must complete registration, or they will face legal penalties.

Starting January 1, brokers who fail to comply could be classified as committing a Class 3 felony, facing two to five years in prison along with fines of up to $25,000. Legislators anticipate that this crypto tax will generate around $60 million in additional revenue for the state government. The budget has passed through the legislature but still requires Governor JB Pritzker's signature to take effect. The governor had previously indicated plans to sign the bill promptly, but as of Friday morning, it has yet to be finalized.

In recent years, crypto trading has gained traction across various states in the U.S., prompting attention to taxation and regulation. Illinois's proposal for a privilege tax aims to regulate digital asset trading, enhance tax transparency, and impose strict penalties on non-compliant brokers.
