Is Binance returning to the United States? Similar to the GENIUS Act for stablecoins signed by President Trump in July, Bitcoin (BTC) and the cryptocurrency sector are advancing at an accelerated pace in the United States. The Commodity Futures Trading Commission (CFTC) recently published new guidelines that could represent a turning point for foreign cryptocurrency companies, including Binance. This article also addresses regulatory constraints.
On August 28, 2025, the Commodity Futures Trading Commission (CFTC) announced new guidelines regarding its registration framework for non-American exchanges, under the oversight of the Foreign Board of Trade (FBOT).
These rules apply to both traditional exchanges and cryptocurrency exchanges. According to Caroline D. Pham, Acting Chair of the Commodity Futures Trading Commission (CFTC), who was appointed by Donald Trump on January 20, 2025, this initiative aims to end the regulatory uncertainty that characterized the Biden administration over the past four years.
American companies that were forced to establish their businesses in foreign jurisdictions to facilitate cryptocurrency trading now have a path back to American markets.

A new era for Binance and non-American cryptocurrency trading platforms
This decision is expected to have a significant positive impact on platforms like Binance specifically. It is worth noting that the latter was violently expelled from the American markets in 2023, at the height of the Biden administration's war against cryptocurrencies.
Because during this Democratic period (2020-2024), American platforms faced significant restrictions compared to their foreign counterparts. Their ability to offer services such as perpetual futures trading and heavy betting was limited.
However, with these new guidelines issued by the Commodity Futures Trading Commission (CFTC), things are expected to change for the better. Major cryptocurrency derivatives platforms, such as Bybit, Bitget, and the aforementioned Binance, can now consider returning to the American market.
The decision of the Commodity Futures Trading Commission (CFTC) comes at a time when the agency is experiencing a significant shift under the new Republican administration. Under President Donald Trump's leadership, the two American regulatory bodies, the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC), launched a "cryptocurrency race" to accelerate the regulation of the Bitcoin sector, in order to compensate for four years of total gridlock.
