PANews reported on February 2 that according to Cointelegraph, Voyager creditor Michelle DiVita and financial lawyers submitted a motion to the court, hoping to appoint a trustee in Voyager Digital's bankruptcy case, which will cause Voyager to lose control of its property. In the motion, Michelle DiVita accused Voyager of having "a history of inaccurate financial statements and public misrepresentations that were known or reasonably discovered at the beginning of the bankruptcy process." Because of this pre-bankruptcy behavior, DiVita believes that an examiner or trustee should be appointed to handle the bankruptcy process. The document stated that Voyager "concealed the true nature of its lending activities by issuing financial reports that seriously underestimated its loan position by more than $1 billion."
