Investbybit Limited, B:Hive, 72 Taharoto Road, Takapuna, Auckland 0622, New Zealand (NZBN 9429047108080), operating under the business name “Binance New Zealand”, and its associated entities and any related bodies corporate (hereinafter referred to as “Binance”, “ us”, “we” or “our” ), is committed to respecting and protecting your privacy and we take our data protection responsibilities with the utmost seriousness.

Our Privacy Notice describes how we collect, use, store and disclose your personal information through the Binance websites and applications that reference this Privacy Notice. Binance refers to an ecosystem comprising Binance websites (whose domain names include but are not limited to https://www.binance.com/en-NZ), mobile applications, clients, applets and other applications that are developed to offer Binance Services, and includes independently operated platforms, websites and clients within the ecosystem (e.g. Binance’s Open Platform, Binance Launchpad, Binance Labs, Binance Charity, Binance DEX, Binance X, JEX, and fiat gateways).

This Privacy Notice applies to all personal information processing activities carried out by us, across platforms, websites, and departments of Binance.

To the extent that you are a customer or user of our services, this Privacy Notice applies together with any terms of business and other contractual documents, including but not limited to any agreements we may have with you.

If you use our websites, even if you are not a relevant stakeholder, customer or user of our services, this Privacy Notice also applies to you together with our Cookie Notice.

We are bound by the Information Privacy Principles contained in the Privacy Act 2020. By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Notice and any other arrangements that apply between us.

1. What Personal Information do we collect and for what purpose?

Personal information means information which identifies you personally, or by which your identity can reasonably be ascertained, the information we may collect is listed in the table below. We may collect personal information about you in order to facilitate your use of binance.com/en-nz (the “Site”) and to provide you with our services.

We collect information in different ways, but most of this information we collect directly from you. For example, when you:

  • Request, get or use our product or services, or products and services you get through us

Transaction services. We use your personal information to process your orders, and to communicate with you about orders and services.

- Communicate with you. We use your personal information to communicate with you in relation to the services provided to you by Binance New Zealand (the “Binance New Zealand Services”).

- We collect and process identity information to verify your identity and comply with our Know Your Customer (“KYC”) obligations under applicable laws and regulations, including anti-money laundering laws and regulations such as the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.

- We may also use identity information for fraud and financial crime prevention, detection and enforcement, compliance data recordation, and credit risk assessment and reporting.

- Binance New Zealand Services metrics (e.g., the occurrences of technical errors, your interactions with service features and content, and your settings preferences);

Provide, troubleshoot, and improve Binance New Zealand Services. We use your personal information to provide functionality, analyse performance, fix errors, and improve the usability and effectiveness of Binance New Zealand Services.

- Transaction information and history

- Information from other sources: we may receive information about you from other sources such as credit history information from credit bureaus

- Information about your behaviour: we may process information about you or your behaviour and your activity for marketing and advertising purposes

- Fraud and financial crime prevention, detection and enforcement, compliance data recordation and credit risk assessment and reporting. We process personal information to prevent and detect fraud and abuse to protect the security of our users, Binance New Zealand Services and others. We may also use scoring methods to assess and manage credit risks, and make reports to credit reference agencies.

- Improve our services. We process personal information to improve our services for you to have a better user experience.

- Recommendations and personalisation. We use your personal information to recommend features and services that might be of interest to you, identify your preferences, and personalise your experience with Binance New Zealand Services.

2. Can Children Use Binance New Zealand Services?

Binance New Zealand does not allow anyone under the age of 18 to use Binance New Zealand Services and does not knowingly collect personal information from children under 18.

3. What About Cookies and Other Identifiers?

We use cookies and similar tools to enhance your user experience, provide our services, enhance our marketing efforts (including by targeting advertising) and understand how customers use our services so we can make improvements. Depending on your settings in our cookie consent manager on your mobile device, the following information may be collected through cookies or similar technology: your unique device identifier, mobile device IP address, information about your device’s operating system, mobile carrier and your location information (to the extent permissible under applicable law). 4. Does Binance New Zealand Share My Personal Information?

Binance New Zealand may share users' personal information with third parties (including other Binance entities) if we believe that sharing your personal information is for one of the purposes outlined under point 1 above, or is required or permitted by applicable law, regulation or legal process. For any other transfers, we will ask for your consent. When sharing your personal information with other Binance entities we will use our best endeavours to ensure that such entities are either subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

For example, we may share your personal information with the following persons:

  • Third party service providers: We employ other companies and individuals to perform functions on our behalf. These third-party service providers only have access to personal information needed to perform their functions but may not use it for other purposes. Further, they must process the personal information in accordance with our contractual agreements and only as permitted by applicable data protection laws.

  • Legal Authorities: We may be required by law or by a Court to disclose certain information about you or any engagement we may have with you to relevant regulatory, law enforcement and/or other competent authorities. We will disclose information about you to legal authorities to the extent we are obliged to do so according to the law. We may also need to share your information in order to enforce or apply our legal rights or to prevent fraud or financial crime.

  • Business transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, user information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the user consents otherwise). Also, in the unlikely event that Binance New Zealand or substantially all of its assets are acquired by a third party, user information will be one of the transferred assets.

To facilitate our global operations Binance New Zealand may transfer your personal information internationally.

Binance New Zealand puts in place suitable technical, organisational and contractual safeguards to ensure that such transfer is carried out in compliance with applicable data protection laws and regulations.

We design our systems with your security and privacy in mind. We have appropriate security measures in place to prevent your information being accidentally lost, used, disclosed or accessed in an unauthorised way, altered or disclosed. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your personal information. In addition, we limit the access to your personal information to those employees, agents, contractors and other third parties who have a business need to know.

Our security procedures mean that we may ask you to verify your identity to protect you against unauthorised access to your account password. We recommend using a unique password for your Binance New Zealand account that is not utilized for other online accounts and to sign out when you finish using a shared computer.
