The CFTC has just updated a version of its “Tokenized Assets” FAQ, and the discussion reads like regulatory gates are opening.
Don’t misunderstand. What it says is: futures brokers and clearinghouses may invest clients’ funds into tokenized versions of “the kinds of assets that are already allowed”—provided that after tokenization, the legal and economic rights are the same as, or functionally equivalent to, the traditional form, and that it still meets the usual requirements around liquidity, custody, concentration, and more.
It’s not “clients’ funds can freely buy crypto.” Payment stablecoins and other crypto assets still aren’t on the eligible collateral list for variation-margin purposes of uncleared swaps.
Blockchain recordkeeping can work, but if you use a public chain, you must be able to retrieve the records for regulators even if the network goes down.
My take: don’t treat an “updated guidance” as a blanket loosening that you should chase narrative coins. First check whether it has written any asset types into the eligible list, then see whether there’s real money following on the chart; the mainstream is still catching its breath right now, so I’m not chasing.
