"Binance Australia Millionth User" Promotion Terms & Conditions
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents (excluding residents of ACT and SA) aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.Ā
Entries into the promotion open at 9:00am AEDST on 10/11/2022 and close at 11:59pm AEDST on 14/12/2022 (āPromotional Periodā).
There will be one (1) draw conducted for entries received each day of the Promotional Period for a total of 35 draws (each a āDaily Drawā) and one (1) draw conducted at the end of the promotion from all valid entries received during the Promotional Period (āMajor Drawā).Ā
To be eligible to enter and receive an automatic entry into the relevant Daily Draw and the Major Draw, individuals must complete any of the below activities during the Promotional Period (each an āActivityā). Subject to creating an Account (as detailed below) which can only be completed once, individuals can earn one (1) entry per day of the Promotional Period per Activity completed. Registrations of corporate accounts and or Activities completed by corporate accounts are excluded.Ā
ActivitiesSign up and create a Binance Australia account (āAccountā) and complete the āKnow Your Customerā verification process (if not done so already). Individuals will be awarded one (1) entry for creating an Account. Individuals can only create one (1) Account, so if they already have an Account prior to the Promotional Period, they will not be eligible for an entry for any entry associated with creating an Account.Ā
Make a deposit of either Australian Dollars or crypto currency into your Account. Make a spot trade using AUD or cryptocurrency within your Account. For more details on how to make a spot trade, see https://www.binance.com/en-AU/support/faq/115003765031.Ā
Refer a friend or family member to create their own Account via the Binance Standard Referral Mode. All referrals must be via the entrantās unique referral link available within their Account. For more details om how to make a referral see, https://www.binance.com/en-AU/support/faq/cbac15853b0243cda4a90c9c03ca0c38. While multiple referrals are permitted, only successful referrals will equate to an entry into the promotion (i.e. where a person successfully creates an Account (during the Promotional Period) using the entrantās unique referral link) and only (1) entry is permitted per person per day. For the removal of doubt, if an entrant refers three (3) friends and all three (3) friends successfully create an Account using the entrantās unique referral link on the same day (during the Promotional Period), the entrant will only receive one (1) entry into the promotion and the entry will be awarded into the Daily Draw associated with the day that the friend successfully created an Account.Ā For further clarity, referred friends that successfully create an Account (during the Promotional Period) using an entrantās unique referral link will also be awarded one (1) entry into the promotion as they will have completed an Activity in accordance with Clause 6 (a).
Multiple entries are permitted, subject to the following: (a) only one (1) entry is permitted per day per Activity completed (with the exception of creating an Account); and (b) each entry must be submitted separately and in accordance with entry requirements.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrantās identity, age, place of residence and their Account activity) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable or illegible entries will be deemed invalid. Any Activities that are cancelled or transactions refunded will not be eligible for an entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Subject to the starting and closing time of the Promotional Period, entries into each Daily Draw will openĀ at 12am and close at 11.59pm each day based on NSW local time. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s), however, all entries (including the Daily Draw winners) will be entered into the Major Draw.Ā
All draws will take place at JustCo, Level &, 276 Flinders Street, Melbourne VIC 3000. Each Daily Draw will take place at 11:00am AEDST on the dates listed in the table below. For the avoidance of doubt, a Daily Draw for each day will take place on the date specified in the table (ie Daily Draws 1 ā 7 will take place on 18/11/2022 and so on). The Major Draw will take place at 11:00am AEDST on 21/12/2022, in the presence of an independent scrutineer. In all instances, the Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
All winners will be notified in writing by email, using the email address linked to their Account within seven (7) business days of the relevant draw. All winnersā names will be published online at https://www.binance.com/en-AU/blog on 23/12/2022.
The Promoterās decision is final and no correspondence will be entered into.
The first valid entry drawn in each Daily Draw will each win a 1x Binance Coin (āBNBā) valued at AUD$432.46 (as at 25/10/2022).
The first valid entry drawn in the Major Draw will win 1 Bitcoin (āBTCā) valued at $30,565 (as at 25/10/2022) as well as a Binance Australia 5year Anniversary Prize Pack valued at $250 which includes a t-shirt valued at $75, slide shoes valued at $60, floormat valued at $50, bucket hat valued at $30, water bottle valued at $20 and a pair of socks valued at $15. Total prize is valued at Ā Ā Ā Ā Ā $30,815 as at 25/10/2022. Exact sizes/colours where relevant to be determined by the Promoter in its absolute discretion.
BNB and BTC prizes will be credited to the winnerās Account once winners have been verified.
Prizes are subject to the standard terms and conditions of individual prize and service providers.Ā
Subject to the unclaimed prize draw clause, if for any reason a winner does not take / a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.Ā
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $45,951.10. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.Ā
A draw for any unclaimed prizes may take place on 31/01/2023 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email, using the email address linked to their Account within seven (7) business days of the relevant draw. Winnersā names (if any) will be published online at https://www.binance.com/en-AU/blog on 03/02/2023.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Binance Australia website to undertake any of the Activities is the entrantās responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutoryĀ consumer guarantees as provided under theĀ Competition and Consumer Act, as well as any other implied warranties under the ASIC Act orĀ similarĀ consumer protection laws in the States and Territories of Australia (āNon-Excludable Guaranteesā). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (includingĀ its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of theĀ promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,Ā the Promoter (includingĀ its respective officers, employees and agents)Ā is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoterās control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.Ā
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed atĀ https://www.binance.com/en-AU/Australia-privacy-policy.
