Terms and Conditions of Entry

General

  1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions.

  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail. 

  3. The promoter is Investbybit Pty Ltd ACN 621 652 579, 315 Brunswick Street, Fortitude Valley QLD 4006  (“Company”)

  4. Entry is only open to Australian residents who are over the age of 18 and who have fulfilled the requirements set out below (“Eligible Entrant”).

Entrants must provide contact details on request to be eligible to win. Entrants may only enter their names. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid. 

Number of Entries Permitted

Only one (1) entry per user is permitted 

Open, Close, Draw and Publish dates

The Giveaway starts 27th of May 2022 at 12:00 PM AEST and closes on the 30th of May 2022 at 11:59 PM AEST (“Promotional Period”). All times noted in these Terms and Conditions are local times, based on the location of the Company. 

  1. The draw will occur at 315 Brunswick street fortitude valley QLD 4006 on 1st June 2022 at 10:00 AM AEST. Each entrant will be designated a corresponding numbered ticket, and a randomised draw will select Five (5) winners from the pool of valid entries in a game of chance. 

  2. Five (5) winners will receive a “Mirror Generation 2 NFT Ticket” (“Prize”).

  3. Prizes, or any unused portion of a Prize, are not transferable or exchangeable. Where a Prize is unavailable for any reason (including if the Prize is abandoned, varied, called off, or postponed for any reason), the Company may substitute the prize in its discretion for another item of equal or higher value.

  4. If a winner does not take/redeem a prize by the time stipulated by the Company, then the prize will be forfeited.

  5. Once Prizes have left the Company's premises, the Company and their associated agencies take no responsibility for Prizes damaged, delayed, or lost in transit.

  6. The Company accepts no responsibility for any tax liabilities that may arise from an entrant winning and accepting a prize in connection with the Promotion. 

Winner Notification Period

  1. The Binance Australia Twitter account will notify the winner within seven (7) days of the draw. Their Twitter handle will be published on the official Binance Australia Twitter page before 3rd June 2022. 

  2. The Company takes no responsibility where it cannot contact prize-winning entrants who have not provided correct or complete contact details. If an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Company. A request to modify any entry information should be directed to the Company. 

  3. A draw for any unclaimed prizes may take place on 8th June 2022 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing within seven (7) days of the draw, and the winner will receive a Twitter message from Binance Australia.  

  4. The Company reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Company has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Company's discretion. Failure by the Company to enforce any of its rights at any stage does not constitute a waiver of those rights. The Company's legal rights to recover damages or compensation from such an offender are reserved.

  5. The Company’s decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each entrant. No correspondence will be entered into. 

  6. All Entries and any copyright subsisting in the entries become and remain the property of the Company who may publish or cause to be published any of the entries received.

  7. The Company (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Company corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Company will disqualify any individual who has tampered with the entry process or any other aspect of this competition. 

  8. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

  9. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Company (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize. 

  10. If the Company does incur liability to an entrant which cannot legally be excluded, the Company’s liability in respect of the Promotion is limited to either resupplying such goods or services as form part of the Promotion or paying the cost of resupplying those goods or services, determined by the Company in its absolute discretion.

  11. Under no circumstances should either the Company(or any of its suppliers or contractors) or the entrant be liable for any loss or damage suffered which is indirect or consequential, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
