Judge Jackson asked the SEC lawyers to "distinguish between 'cryptocurrency assets' and 'cryptocurrency asset securities'." In response, SEC attorney Matthew Scalato provided several examples of cryptocurrencies that the SEC considers to be securities in its complaint. However, he reserved the evaluation of the remaining tokens on the Binance exchange. When Judge Jackson asked Binance, "If it's not a security, is it a commodity?" about Binance's BNB, which the SEC has argued is a security, Binance US attorney Matthew Martens replied, "It's a cryptocurrency."
