The National Integrated Customs and Tax Administration Service (SENIAT) considers P2P (Peer-to-Peer) operations as a commercial activity that could generate net enrichment, requiring accurate documentary support to justify the volume of transactions in your bank accounts and to calculate the Income Tax (ISLR).

When filing a tax return or facing an audit related to transactions associated with the buying and selling of cryptoassets, the main requirements are:

  • Bank account statements: A detailed record of all your domestic accounts (bolívares or foreign currency). SENIAT uses these reports to cross-check the amount of money entering and leaving against what you declare as income.

  • Transaction history of the platform: A consolidated report exported directly from the exchange showing that the bank transfers you received and sent legitimately correspond to counterparty cryptocurrency transactions.

  • Justification of the source of funds: Documentation that validates where the initial capital (fiat or crypto) you used to start trading came from. This may include payment receipts, settlement certificates, the sale of assets, or inheritances.

  • Calculation of net enrichment: A common mistake is to assume that SENIAT collects taxes on all the money that passed through the account. The tax authority requires an accounting relationship (ideally endorsed by a registered accountant) that demonstrates your real gain; that is, the asset’s sale price minus its acquisition cost and operating commissions.

  • Definitive ISLR Declaration Spreadsheet: The final document where the net profit obtained from P2P activity during the fiscal year is recorded, submitted within the corresponding legal timeframe.

Because the P2P transaction volume is usually very high and triggers anti–money laundering legitimacy alerts (Sudeban) at banks even before reaching SENIAT, maintaining strict monthly accounting and periodically downloading the receipts for your transactions is the only way to avoid preventive account blocks or fines for tax inconsistencies.
