California just opened a new front against the SEC's crypto rulebook.

The state's Department of Financial Protection and Innovation filed a comment letter opposing the SEC's proposed "Regulation Crypto Assets," arguing it would preempt state securities registration and strip California's authority to screen digital-asset offerings pre-market. The DFPI cites a record $11.3B in 2025 crypto scam losses (FBI IC3) and nearly 200 new scams it added to its tracker this year.

The fight is preemption: a federal exemption for "covered" offerings that displaces state registration kills California's biggest lever against abusive issuances. The SEC unveiled the proposal in August after CLARITY stalled in the Senate, and the comment window closed Oct 20 — so this letter is a late push, not a veto.

Watch the signal: state vs. federal jurisdiction is the next big fault line in US crypto policy. If other states follow, the framework faces real friction.

Does federal preemption make crypto safer for investors — or easier for bad issuers? DYOR.
