South Korea has established procedures for courts to seize and sell debtors' cryptocurrency to satisfy civil claims. The Supreme Court promulgated Rule 3280 on Oct. 12, with the regulations taking effect on Nov. 1 for exchange-held assets and private wallets. The rules permit enforcement officers to receive directly held cryptocurrency before debtors receive formal notice of an attachment order. However, enforcement against self-custodied assets could remain difficult when debtors control the private keys. Debtors can appeal decisions authorizing transfers or sales, which take effect only after becoming final. The new procedures also apply to proceedings already before the courts.
