Former Defence Secretary Mark Esper is pushing the CLARITY Act
as a national security issue, not just a financial one.
In a Financial Times op-ed, Esper, now a Coinbase adviser, pointed to China's alternative payment infrastructure and North Korea's crypto use as reasons to keep digital assets within US regulatory reach, warning activity could shift offshore without the bill. He noted the Act would extend Patriot Act provisions to digital assets to help target threat actors.
The bill would give the CFTC jurisdiction over digital commodity spot markets while the SEC retains oversight of investment contracts, alongside expanded AML and Treasury authority.
It passed the House in July 2025 but stalled in the Senate over ethics and community banking concerns. A procedural cloture vote requiring 60 votes is set for September 15, the last chance for passage in 2026.
