The chances of the CLARITY Act passing before the Senate recess are looking very slim. If it doesn't get approved this week, the next real opportunity moves to September. Missing that window could push implementation all the way to 2027 after the midterm elections.

The biggest disagreement is still over crypto ethics rules that Democrats want to add for senior government officials, and those provisions haven't been included in the current draft.

While regulations remain uncertain, big players like Coinbase and Circle are in a much stronger position than smaller crypto firms and DeFi projects. ARK Invest recently added more shares of both companies, and Circle has already secured a federal national trust bank charter.

Market sentiment has also cooled. Polymarket now shows only a 23% chance of the CLARITY Act passing in 2026, a big drop from earlier expectations.
