Waiver to expire by end of 2025
TSMC confirmed that the U.S. government has notified the company that its VEU authorization for the Nanjing plant will be revoked effective December 31, 2025. The company said it is still evaluating the situation and in talks with U.S. authorities, but stressed its commitment to keeping the plant running without disruption.
Without VEU status, TSMC’s suppliers will need to apply for licenses for every individual shipment of U.S.-controlled semiconductor equipment to Nanjing, rather than relying on automatic approval. While U.S. regulators insist they will grant the necessary authorizations, firms worry about how quickly the growing backlog of license requests can be processed.

Limited impact on production, but investors rattled
Taiwan’s Ministry of Economic Affairs warned that the loss of the waiver could create uncertainty around production in Nanjing. However, since the facility accounts for only about 3% of TSMC’s total manufacturing capacity, the ministry expects only a limited impact on the company’s global competitiveness.
Investors, however, reacted nervously – TSMC’s American Depositary Receipts (ADRs) traded in New York fell as much as 2.3% on Tuesday.

Suppliers under pressure
TSMC’s biggest suppliers include Applied Materials, ASML, Tokyo Electron, and KLA. Their shares also dropped following the announcement – with some falling more sharply than the broader market. These companies were already operating under U.S. export restrictions to China, and the removal of TSMC’s waiver could bring further complications to their cooperation.

Samsung and SK Hynix already lost waivers
Just last week, Samsung and SK Hynix also lost their VEU status. The Bureau of Industry and Security (BIS) explained the move as an effort to “close loopholes in export controls” that it said placed U.S. companies at a disadvantage. Officials noted this change would add about 1,000 new license reviews annually.
While TSMC’s VEU status was never formally listed in the Federal Register, the practical effect is the same – suppliers to its Chinese plants will soon need individual U.S. approvals for restricted equipment shipments.

Part of Washington’s broader strategy
In recent years, the U.S. has rolled out sweeping export restrictions to prevent China from acquiring advanced chipmaking tools that could be used for cutting-edge semiconductors and artificial intelligence.
Although the Biden administration initially allowed TSMC, Samsung, and SK Hynix to continue equipment shipments to their Chinese facilities under strict security and transparency conditions, the gradual removal of waivers shows Washington is shifting toward a harder line.
