Coinbase recibió la aprobación condicional de la Oficina del Contralor de la Moneda (OCC) para crear Coinbase National Trust Company, dándole al exchange una base regulatoria federal para su negocio de custodia.
La carta de la OCC está diseñada para activos en custodia, no para actividades bancarias comerciales. Coinbase no aceptará depósitos minoristas ni realizará banca de reserva fraccionaria bajo este marco.
¿Qué significa para Coinbase la carta orgánica de la OCC?
La aprobación se enfoca en las operaciones actuales de custodia e infraestructura de mercado de Coinbase. La supervisión federal por medio de la OCC reemplaza el sistema de regulaciones estatales que antes regía esos servicios.
Greg Tusar, Co-CEO de Coinbase Institutional, explicó el alcance directamente en un comunicado de la empresa.
“Esta carta trata de traer uniformidad regulatoria federal al negocio de custodia e infraestructura de mercado que hemos estado construyendo durante años”, decía un extracto del anuncio, citando a Tusar.

La aprobación condicional significa que Coinbase debe cumplir ciertos requisitos específicos de la OCC antes de que la carta esté totalmente activa. El exchange confirmó que trabajará en conjunto con el personal de la OCC durante este proceso.

La BitLicense otorgada en 2015 al exchange por el Departamento de Servicios Financieros de Nueva York (NYDFS) y su carta actual de Trust estatal permanecen vigentes. Coinbase, Inc. sigue operando bajo la supervisión del NYDFS sin cambios.

La carta federal también crea una base para nuevos productos de pago y servicios financieros relacionados. Tusar mencionó que los socios institucionales y los clientes individuales serán los principales beneficiados de esta nueva capacidad.

El Congreso ha avanzado en legislación sobre la estructura del mercado, pero la supervisión federal para custodios de criptoactivos seguía fragmentada. La aprobación por parte de la OCC responde a esa necesidad a nivel institucional sin esperar una legislación completa.
