Newsom Signs AB 2409 Into Law

California Governor Gavin Newsom has signed Assembly Bill 2409, making the state the first in the United States to explicitly bar public officials from creating, issuing, or promoting memecoins. Newsom signed the bill on September 27, making California the first state to explicitly bar public officials from creating or promoting their own tokens.

The bill was introduced by Assemblymember Avelino Valencia in February 2026. It passed with rare bipartisan consensus: 40-0 in the Senate and 78-0 in the Assembly.

AB 2409 casts a wide net over who counts as a covered official. The law applies to state and local elected officials, members of legislatures, advisory board members, and specific public employees who hold contracting authority. The law also prohibits digital asset service providers from offering certain memecoins issued by or in partnership with federal, state, or local public officials to California residents, and applies to tokens issued on or after January 1, 2027.

Conflict of Interest at the Core

Newsom framed the legislation as a straightforward anti-corruption measure. "No official should profit off their office, and we're putting stronger protections in place to ensure it doesn't happen in our state," Newsom said, as he also criticized former President Trump's launch of a memecoin in 2025.

The law also prevents companies from listing any memecoin that uses a public official's likeness or image. It authorizes California's attorney general, a district attorney, a city attorney, or county counsel to enforce the prohibitions by filing a civil action.

AB 2409 does not name any specific tokens or projects. It is written broadly to cover any memecoin that a public official might create or endorse going forward, making it a forward-looking framework rather than a retroactive measure. The civil-only enforcement mechanism is also worth watching. Without criminal penalties, the deterrent relies on the threat of financial disgorgement and injunctions.

Newsom also signed Senate Bill 1208, which expands California's existing money laundering statutes to include illicit transactions made using digital assets and broadly authorizes law enforcement to freeze, seize, and forfeit digital assets linked to crimes.
