Tomorrow, the US Senate decides the next 4 years of American crypto. The CLARITY Act answers one question that has never had a legal answer. When is a token a security, and when is it a commodity? For a decade that was settled by lawsuits and enforcement actions instead of law. Everything holding the industry together right now is temporary. The SEC and CFTC issued joint guidance in March classifying 16 digital assets, and the next administration can erase all of it without a single vote. The bill already passed the House in July 2025. It cleared Senate Banking in May. Then it stalled for four months over ethics rules, DeFi liability and stablecoin yield. Tomorrow is not even a vote on the bill. It is a vote on whether the Senate is allowed to debate it. That takes 60 votes, Republicans hold 53 seats, and prediction markets give it 16 percent. If it fails, America waits until 2027.
