Senate Leaves the CLARITY Act in Limbo
The Digital Asset Market Clarity Act, Washington's most ambitious attempt to create a federal framework for crypto markets, is running out of time. Miller Whitehouse-Levine, CEO of the Solana Policy Institute (@millercwl), puts the odds of passage before the 2026 midterms at roughly 10%, describing the bill's current status as being in "August recess purgatory."
The Senate has spent more than a year working on the legislation. The bill would create a federal framework splitting oversight of crypto markets between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). Yet despite clearing the House in July 2025 with a 294-to-134 margin, with more than 70 Democrats crossing the aisle, the Senate version has struggled to build the coalition it needs.
The Senate delayed a floor vote ahead of the August 2026 recess due to partisan disagreements over ethics rules and banking opposition, scheduling a procedural vote for September 15, 2026, a cloture vote on the motion to proceed that requires 60 votes to overcome a filibuster. Whitehouse-Levine noted that several additional votes would still be needed even after that scheduled motion, and that growing involvement from banks and financial firms is adding further complications.
Prediction Markets Price In Long Odds
Independent forecasters align with that cautious read. Galaxy Digital lowered its estimate for the CLARITY Act passing Congress this year to 10% on August 15, down from a previous figure of 50% set by Alex Thorn, Galaxy's head of firmwide research. Thorn tied the cut to timing, noting the Senate reconvenes on September 14 and has only two to three weeks of floor time before other priorities crowd the schedule.
The procedural math is also daunting. Republicans currently hold enough seats to bring the bill forward but need approximately 10 Democratic senators to clear the filibuster threshold. Outstanding issues lawmakers still need to resolve include government ethics, law enforcement provisions, and stablecoin yield and rewards.
With the 2026 midterm elections approaching, every delay reduces the time available for a politically difficult bill requiring support from both parties. If the vote slips further, the bill would have to wait until after the elections to return to the Senate for a final vote, which is not optimal since the outcome of the elections could change the priorities of the legislature.
