Forbes journalist Eleanor Terrett reports that, as outlined on page 49 of the draft, sales of digital commodities are not considered securities transactions—so long as they do not provide the buyer with ownership rights in the issuer’s business, profits, or assets. Essentially, the buying and selling of digital commodities on the secondary market won't automatically fall under U.S. securities laws unless the transaction involves claims to ownership or profit-sharing in the issuing entity.
